The Promoter is Fluidra Group Australia Pty Ltd (ABN: 87 002 641 965) ("Promoter") of 1 Herbert Place, Smithfield, NSW 2164, Australia. By entering this competition, you accept and agree to these terms and conditions as well as the decisions of the Promoter.

Eligible Claimants / Entrants

Entry is only open to legal residents currently residing in Australia and New Zealand who are aged 18 years or over who have purchased Eligible Cashback Products from a Participating Dealer during the Promotional Period.

Method of Entry

To enter, an Eligible entrant must, during the Promotion period:

  • Purchase an Eligible Cashback Product from a AstralPool or Zodiac participating dealer
  • Visit www.poolcleanerpromo.com to successfully complete the online application form and include the entry of a valid tax invoice with a zero balance.
  • All required information must be submitted within the Claim Period. The Promoter accepts no responsibility for claims not submitted by this date and no claim received after this date will be processed.
  • Claims are not transferable or assignable. Only the purchaser of the Eligible Cashback Product may submit a claim in respect of that product.
  • The Claimant must purchase the Eligible Product for their own personal use in Australia and not for the purpose of commercial resale (ie. the Claimant must be the end user of the product).
  • Tax invoices must not be tampered with and be legible

If the Claimant submits a valid claim to The Promoter in accordance with these terms and conditions, the Promoter will pay the Claimant the Cashback Amount, if applicable, and provide an entry into the Chance to Win draws plus provide the prizes to the winners. The Claimant must provide a valid Australian bank account to receive the Cashback claim amount.

Maximum Number of Entries

Only one (1) claim of Eligible Cashback Product purchased can be made per person.

Entrants may purchase any one of the Eligible Cashback Products included in the Promotion.

Not all products listed in the Eligible Cashback Products have a Cash Back value, but all products listed under Eligible Cashback Products are entitled to enter the Chance to Win draw for both Weekly Prizes and Major Prize.

Eligible Cashback Products refers to any AstralPool or Zodiac Robotic Pool Cleaners purchased during the Promotional Period. This is for new products only and does not include refurbished or second-hand products.

Details of Prizes

The Promotion is the combined marketing activity across both Australia and New Zealand, offering consumers a Cash Back Bonus plus a Bucket Hat, a chance to win 1 of 10 Weekly Prizes and a chance to win one Major Holiday Prize, when they purchase eligible AstralPool or Zodiac products listed in Eligible Cashback Products.

Total Number of Prizes and Cash Backs

There will be no limit on the number of Cash Backs and Buckets Hats available. This is not a chance to win but a bonus on eligible products listed in Eligible Cashback Prizes.

There are 10 Weekly Prizes and 1 Major Prize. Total number of prizes is 11.

The total numbers of prizes cover all claims and entries in both Australia and New Zealand.

Total Prize Value

The total prize pool is valued at AUD $25,000.

Cash Back Payments and Prizes

Cash Back(s) are payable via EFT using the Cash Selector Platform.

The Promoter will issue the payment, via Electronic Fund Transfer (EFT), into your Australian/New Zealand bank account within twenty-one (21) Working Days of receipt of all evidence required by the Promoter for a valid claim ("Payment"). The method will be via the Cash Selector platform.

Weekly Prize

Each weekly prize is an AUD $500 Prezzee Voucher. This digital voucher will be emailed to the email address provided by the Entrant.

Major Prize

The major prize for this promotion is a Trip for 2 adults to Paris valued at up to AUD $20,000.

This is inclusive of the following:

  • 2 x adult economy return flights from Australia to Paris
  • Airport transfers from Paris Airport to the Hotel and return
  • 6 nights’ accommodation in a 4-star hotel in central Paris including breakfast
  • AUD$5000 spending money (EFT transfer 14 days in advance of the planned travel date)
  • Travel Insurance
  • The trip needs to be taken within 12 months of winning the prize and the winners need to provide 6 months’ notice of travel dates.
  • There may be ‘black out’ periods for travel due to availability.
  • Return flights can be extended past the 6-day accommodation period but all other additional costs are to be covered by the winner.

Weekly and Major Prizes

    Each eligible entrant will be placed in a prize draw. Winners will be selected at random via a prize draw of eligible entrants. The draw will be conducted electronically using a random drawing process.
  1. The prizes will be drawn on the dates and times as specified under the Weekly Prize and Major Prize sections detailed above.
  2. The winners of the Weekly Prizes and Major Prize will be notified within 2 business days of the relevant draw by the Facebook and Instagram post announcements and subsequently a direct message on Facebook and via email and will be required to respond if contacted to confirm identity. If potential winners cannot be contacted by the Promoter for any reason or does not respond within 14 days, or if a potential winner is determined to be ineligible or otherwise not in compliance with these Terms and Conditions, this will result in disqualification of the potential winner and prize forfeiture. If disqualified, an alternate winner may be randomly selected from among all remaining eligible entries received.
  3. Weekly Prizes will be sent electronically to the winners’ email accounts they have provided within two (2) weeks after the winners have been contacted and confirmed. The Promoter is not responsible for misdirected Prize email if the email provided by the entrant is inaccurate or incorrect.
  4. The Prezzee eGift cards are valid until the expiry date specified on the gift voucher or by the gift voucher provider. The Prezzee eGift Card is governed by certain terms and conditions established by the issuing Retailer in addition to these Terms. Retailers set expiration dates for Gift Cards in addition to other restrictions and requirements. The prizes are not transferable or redeemable for cash.   5. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  6. The Promoter and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, or misdirected mail.
  7. All passengers will need to provide the relevant travel documentation at their own cost. Major Prize winners will need to check what travel documentation they require to travel from Australia/New Zealand to France.
  8. Major Prize winners will need to add any special medical requirements needed for travel insurance. Travel insurance will not cover extreme or dangerous sports or motorcycle riding. If hiring a vehicle in Paris, then winners will need to purchase their own insurance for this.
  9. Any changes to the confirmed prize details will be at the expense of the Major Prize winner(s) and will only be permitted with the prior consent of the Promoter or third-party travel provider.
  10. Unless otherwise stated, any travel prize does not include travel documents, meals, taxes not included in the price of the ticket, or any other costs of a personal nature. Compliance with any health, travel insurance, passport or other government requirements is the responsibility of the prize winner. Failure to comply with this will deem the winner’s entry invalid and the entrant will forfeit the prize. The Promoter makes no representation as to safety, conditions or other issues that may exist as part of the travel or at the destination.
Notification of Winners

Winners of the weekly prizes and the major draw prize will be contacted within 2 business days of the relevant draw via email to confirm details and delivery (exact method of notification being in Promoter’s sole discretion).

Notification of unclaimed prize winners

Unclaimed prize winners will be notified via email & phone no later than two (2) business days after the unclaimed prize draw.

Public announcement of winners from unclaimed prize draw

The winners will be announced on the AstralPool and New Zealand websites: www.astralpool.com.au/summerpoolcleanerpromotion, www.astralpool.co.nz/summerpoolcleanerpromotion, www.zodiac.com.au/summerpoolcleanerpromotion and www.zodiac.co.nz/summerpoolcleanerpromotion no later than seven (7) days after the draw.

Cash Selector Terms & Conditions

The cashback shall be transmitted by means of the CashSelector platform. A claimant with verified/validated claim shall be sent an email containing a CashSelector link. This email will be sent to the email address provided by the claimant in their claim. It is the claimant’s responsibility to ensure the email address provided in the claim is correct, active and monitored.

By following the link, the claimant may choose to have the value of the cashback transmitted via:

Electronic Funds Transfer (EFT) to an Australian bank account.

CashSelector links will expire after the "valid period". The "valid period" is determined by the promoter and is six (6) months from the date of issue. Use of the CashSelector platform and CashSelector links are subject to the terms and conditions located at www.cashselector.com.au/tnc, as well as the Promoter’s instructions and/or limitations. This includes but is not limited to:

  1. The email address provided must be correct, active and monitored and
  2. The CashSelector link must be used before the link expires "valid period".

The process for receiving the Cash Back is as follows:

  • Once a claim is verified, the Claimant will be sent a Cash Selector email. In the email the Claimant can choose their payment method of EFT.
  • The Claimant will be required to enter the necessary details to complete the transaction. It is the responsibility of the Claimant to provide correct details.
  • If the Claimant provides incorrect banking details, the Payment Promise will not apply to the claim.
  • The additional bonus Bucket Hat will be posted to the address given on the claim form. Please allow up to 21 days for delivery.
Cash Back Claim Conditions
  1. If the Claimant returns a product for which it has received a Cashback Amount the Claimant must return any Cashback Amount already paid to the Claimant by the Promoter in respect of that product.
  2. The Promoter may, at any time, take steps to verify the eligibility of any Claimant or the validity of any claim submitted. If the Promoter reasonably believes that the Claimant is ineligible for the Promotion or that a claim is invalid, the Promoter may reject the claim and/or pursue the Claimant for any monies already paid to the Claimant. The Promoter’s decision on eligibility and validity is final and no correspondence will be entered into.

Terms and Conditions of Participation

  1. Information on how to enter and prize details form part of these terms and conditions. The Terms must be read in conjunction with this Schedule. Participation in this Promotion is deemed acceptance of these Terms of entry.
  2. Entry is open only to legal Australian and New Zealand residents aged 18 years or over (‘Eligible’) of the Eligible States/Territories who satisfy the Terms of Entry. Businesses and government agencies are ineligible to enter. Directors, officers, management, employees, suppliers, (including prize suppliers) and contractors (and the immediate families of directors, offers, management, employees, suppliers and contractors) of the Promoter and of its related bodies corporate, and of the agencies and companies associated with the Promotion, including their immediate family are ineligible to enter.
    1. Immediate family means any of the following: spouse, ex-spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  3. The promotion will be conducted during the Promotion period. Only one (1) entry per person is permitted in this promotion.
  4. The time zone applicable to any time stated, relates to the state or territory where the Promoter is located unless expressly stated to the contrary.
  5. The Prize/s are specified in the ‘Winners Selection & Prizes’ section of the Schedule.
  6. For the avoidance of doubt, all products listed in the Eligible Cashback Products are eligible to enter the draws for both Weekly Prizes and the Major Prize.
  7. Inaudible, incomprehensible, illegible, and incomplete entries will be deemed invalid, and the promoter accepts no responsibility for the same. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entries process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  8. The total prize pool is specified in the Total Prize Value section of the Schedule.
  9. All Prizes are valued in Australian Dollars unless expressly stated to the contrary.
  10. All Prize(s) will be awarded to the valid entrant(s) drawn randomly in accordance with the Prize draw details. If a draw is scheduled on a public holiday, the promoter may choose to instead hold the draw on the first business day after the relevant public holiday. The Promoter will draw additional reserve entries (and record them in order). In the event of an invalid entry or an ineligible entrant, or if the entrant is ineligible to accept the prize, the prize will be awarded to the first reserve entry drawn. If the prize cannot be awarded to the entrant drawn, the promoter will then continue this process until the prize is awarded.
  11. The winner does not need to be present at the draw unless expressly stated to the contrary.
  12. The winner(s) will be notified in accordance with the ‘Winner Selection & Prizes’ section of the Schedule. Notification to winners will be deemed to have occurred on the later of the time the winner receives actual notification from the Promoter. The notification will include details about how the prize(s) can be claimed.
  13. The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If the entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter.   14. The winner(s) name and state/territory of residence will be published in accordance with the public announcement of winners’ section of the Schedule (if applicable).
  15. By entering the Promotion, an entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or Winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
  16. Without limiting any of the foregoing, in no circumstances will an entrant or the Promoter have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including without limitation any loss of profit, loss of reputation, loss of goodwill or loss of business opportunity.
  17. The Promoter may in its absolute discretion not accept a particular entry, may disqualify an entry, or cancel the entire Promotion at any time without giving reasons and without liability to any entrants, subject to any written directions from a regulatory authority. Without limiting this the Promoter reserves the right to verify the validity of entries, prize claims and entrants and to disqualify any entrant who submits an entry or prize claim that is misleading or not in accordance with these Terms of entry or who manipulates or tampers with the entry process. In the event that a winner breaches these Terms of entry, the winner will forfeit the prize in whole and no substitute will be offered. Verification is at the discretion of the Promoter, whose decision is final. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  18. Prizes, or any unused portion of a prize, are non-transferable and/or not exchangeable and/or cannot be taken as cash, subject to any written directions from a regulatory authority. This Promotion cannot be redeemed in conjunction with any other promotion, including any other cashback promotion or rewards program. The Promoter accepts no responsibility for any variation in prize value (including between advertising of the Promotion and receipt of the prize).
  19. Payments are not transferable, assignable or exchangeable for other goods or services and are governed by Australian law.
  20. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability (or that of a third party involved with the Promotion) to proceed with the Promotion on the dates and in the manner described in these Terms of entry, including but not limited to vandalism, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter’s obligations in respect of the Promotion will be suspended for the duration of the event and, in addition, the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to approval of the relevant authorities.
  21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
    1. invalidate any claim.
    2. to disqualify any Entrant from participating in this and any future promotion; or
    3. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  22. All entries become the property of the Promoter. Entrants consent to the Promoter using their Personal Information ("PI") including but not limited to their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. By entering this competition, entrants agree and understand that their written entries may be used for promotional purposes without any further reference, payment or other compensation to the entrant.
  23. The Promoter accepts no responsibility for any tax implications that may arise from the Promotion. Independent financial advice should be sought by the Claimant.
  24. The Promoter collects personal information to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entries are conditional on providing this PI. The PI collected in this promotion will be disclosed to FLUIDRA GROUP AUSTRALIA Pty Ltd. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.astralpool.com.au/privacy-policy or www.zodiac.com.au/privacy-policy In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
  25. Claimants should direct any requests to access, update or correct their personal information using the ‘Help’ button on the claim website.
  26. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and the New Zealand CGA("Non-Excludable Guarantees").
  28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion or use of any prize.
